This is the procedure that must be followed per Vermont State Statues.  This policy trumps anything that is written in the Fairfax Town Handbook.

Sub-Chapter 6: Vacancies In Town Offices

§ 961. Vacancy or suspension of officer's duties

(a) When a town officer resigns his or her office, or has been removed therefrom, or dies, or becomes unable to perform his or her duties due to a mental condition or psychiatric disability, or removes from town, such office shall become vacant. Notice of this vacancy shall be posted by the legislative body in at least two public places in the town, and in and near the town clerk's office, within 10 days of the creation of the vacancy.

(b) In the event there are so many vacancies on the selectboard that a quorum cannot be achieved, the remaining selectperson or selectpersons shall be authorized to draw orders for payment of continuing obligations and necessary expenses until the vacancies are filled pursuant to section 963 of this title.

(c) The legislative body of a county, municipality, or special purpose district may designate a person to perform the duties of an officer whose duties have been suspended as a condition of release pending trial for violating 13 V.S.A. § 2537. (Amended 1981, No. 239 (Adj. Sess.), § 27; 1993, No. 115 (Adj. Sess.), § 1, eff. March 30, 1994; 2007, No. 169 (Adj. Sess.), § 5; 2013, No. 96 (Adj. Sess.), § 150.)

§ 962. Special meeting

A town at a special meeting may fill a vacancy in a town office.

§ 963. Duties of selectpersons; special meeting

When a vacancy occurs in any town office, the selectpersons forthwith by appointment in writing shall fill such vacancy until an election is had; except that in the event of vacancies in a majority of the board of selectpersons at the same time, such vacancies shall be filled by a special town meeting called for that purpose. Such appointment shall be filed by them in the office of the town clerk and duly recorded by the town clerk in the book of town records. If there are no selectpersons in office, the secretary of state shall call a special election to fill any vacancies and for that interim shall appoint and authorize the town clerk or another qualified person to draw orders for payment of continuing obligations and necessary expenses until the vacancies are filled. I just spoke with DJ Leach, the Fairfax Road Foreman, he's asking folks to be careful as they are out traveling on the roads. He and Pat will do the best that they can to keep up with the weather, but at this point his department is down one full time employee. The select board has not been able to hire a third person to date. Remember, drive responsibly this winter and if the trip is not necessary please stay home if possible.

Agreed, I cast my ballot via absentee earlier this week.  It was a completely different experience for me, much more relaxing, was able to vote at home and since I was next to my computer while voting I was able to research the candidates that I wasn't familiar with.

I think Chris made it very clear in his last post why the board voted to send RFQ's out for a new trash hauling vendor.  I researched what the average home generates for rubbish & recycling and compared that to what my company was paying for demolition debris disposal at the WSI landfill.  The cost difference was big.  I know you and other have accused me of kickback, favors, ect.  I will never convince you to think any differently.  My pocket were not lined by anyone.

The trucking line item of 395,000.00 accounts for the trash and recycling component of the budget:  Duffy's.  As you can see with just over 2 months left in the year there is still 187,778.86 left in this line item.  Almost a 50% saving year to date by changing contractors.

The additional 13,000.00 is what is budgeted for household hazardous waste day.  This line item was exhausted or nearly in the first hazardous waste day since the normal vendor died and a new vendor was used.

In an earlier post from last year you doubted that there would be any substantial saving from moving to the new vendor.  Chris has provided the data and the projected saving through to the end of the year stand at approx 150,000.00 on a single line item.  This works out to be just under a $100.00 saving for each homeowner in Fairfax.  Based what I see in the profit loss statement, the town is way over budget 113% based on the PL I saw last week.  So unless there is a major accounting error on the P & L it's a good thing the selectboard made the decision to investigate  a new contractor.

I look forward to personally exchanging ideas with you Josh.  You come across as a bright guy, the kind of person who could really add to the governance of Fairfax.

I am not bashing Chris Santee, everything that I stated in my questions can be backed up via taped footage of the selectboard minutes or the Fairfax profit loss statement.  Being asked tough questions is part of the game when one is running for politics or is a politician.  As a public servant or candidate for public service it is an understood duty to defend a position to the electorate.

While acting as Vice Chairman of the selectboard, can you answer why you voted "NO" on changing trash vendors?  Switching vendors from Casella to Duffy's has saved the town of Fairfax in excess of $150,000.00 (estimated 2014) on a $420,000.00 line item 2013.  ( source Town Of Fairfax profit & loss 9/2/14 )

Upon review of the 9/2/2014 Town of Fairfax profit loss statement, the town has spent 97.3% of the budget. Under your leadership as vice chairman, how do you propose to close the budget gap with 4 months left in the fiscal year?

Can you please give some insight regarding your position of Town Library representative as a member of the selectboard during 2012-2013 budget season.  During your time as library rep the position of Librarian became a "full time position".  The balance of the board was blindsided at the 11th hour with a request by the library committee to change the position to full time.  As acting library rep, the planned position change was never reported back to the balance of the selectboard in advance of budgeting for review and discussion.  This one position moving to full time came at a cost of over $10,000.00 to the taxpayers.  Benefits package by itself, at the time alone cost $176.00 per week, plus a salary increase and an extended work week.

I too will be voting for Barbara Murphy, she's the logical voice for Fairfax in Montpelier!

They do not do finger prints. I think it is high time they step up to the plate and get proactive. Fingerprints are not proactive but it might give them a data base to be proactive. I am sick of seeing the police radar for speeders and mean while properties are being broke into. We have had way too many properties just in Fairfax have copper taken from. The police do not even go to the property when reported in some cases. How do they ever expect to catch the burglars?

I believe it comes down to resources. Local PDs and even state police don't have the resources to take prints and process every break in. Our States crime lab is under funded and staffed as it is. Sending them prints to be processed from every break in would drowned them in work. It would likely take a year to get the prints ran and even then there is a good chance the prints wouldn't be on file. As much as I wish like you that this could be done it just isn't a realistic expectation. Shows like CSI give us all a false sense as to what to expect from police and investigations.

Have the police been writing up reports at least? Doesn't it just seem to give the criminals permission to do whatever they want if the police appear to be doing nothing? We had an incident at Eastfield a month ago, a forced entry. No report was taken. It seemed to be a very low key response. We were told that the value of goods taken was under $1500, so nothing would be done. The criminals know the procedures and we are sitting ducks?

Leebeth Ann Lemieux, you're on the Selectboard, schedule Sheriff Norris to be at a board meeting, express your concerns. The town hires the sheriff's department at a yearly cost of $112,056.00. The selectboard can ask for changes in priorities. ( FYI, All of this has been done in the past. The frequency of the meetings was much less in my second year on the board. Bob Horr had both the Sheriff scheduled for quarterly meetings.)

If the criminals know that nothing will be done, nothing at all, why should they stop? If priorities have to be shifted, perhaps it is time. I was very surprised at the lack of police interest. If I were a criminal I would feel safe and protected.

last time we were broken into and robbed, we didn't touch a thing. Waited 2 days for a cop to come. He wrote up a report and I asked if he was going to dust for prints. He looked at me like I was from another planet and said "what do you think we are...CSI???" This is what we pay for

Darlene Witte-Townsend, attend a selectboard meeting to voice your concerns, this way they will be part of the video-taped meeting and part of public record that all community members can see. The selectboard has been advised by their attorney, that they are not required to read aloud any written letters from towns people.

At the last Selectboard meeting I did bring this subject up. I have also spoke about it when Lt Flanagan from the State Police came to a meeting. I will continue along with the Selectboard to try and find other ways we can be proactive. Open invitation for the public to attend Selectboard meetings.
