Constable Kevin Campbell has a petition to include on the ballot the sum of $20K for local protection.  Anyone can call Kevin at 849-6665 or stop in at KMC Auto to sign.

It's only to put it on the ballot.
We would vote yes, or no in March.

Kevin feels confident that this proposal will actually bring revenues in to Fairfax through the purchase of a radar gun.

Although this was the opening for the "Not so Top Ten" on ESPN's Sports Center, I believe the boys and Coach Button deserve a pat on the back.

Milton is a Division II school.
Fairfax is a Division III.

The intensive, but patient, "floating" zone defense of Coach Button has been the subject of several Fairfax News stories and has been written about many times on "The Clubhouse". Even when JP Marriott was putting up 1,000+ points, the defense was getting ink.

Perhaps Milton showed "too much" respect, but the bottom line is that Fairfax basketball commands respect in any Division !!!

Thanks for your post, good point.
I would love to hear from any of "the nine" here with any of their complaints against our former Town Clerk.
 
As Editor of The Fairfax News, I listened to their complaints, obtained and read the lawsuit filed against Levick and got on the phone trying to find out the truth.
 
I spoke with many, many Fairfax residents, asking them if they had anything negative to say about Tina Levick.  
One person said "I heard her swear once."
Outside of that, I received nothing but compliments for the woman.
 
I called attorneys in St. Albans asking them about conduct and efficiency.
I received the same answer time after time:
"Fairfax's Town Clerk's office (under Levick) is the finest in the County for obtaining records.
 
I called the Secretary of State's office and they stated Tina Levick had done nothing wrong.
 
I researched Selectboard Notes from Ed Nuttall and found about two months worth of the Selectboard complaining about Levick having a "drop-box".
I read more and researched the drop-box complaint.
 
It seems in most rural communities, where residents work out-of-town, the Town Clerk has a "drop-box" for residents to drop off documents after hours.  Sounded logical.
I went to Georgia Town Office, where they have a "drop-box" and asked "Have you ever had any problems with the drop-box?"
They paused in silence, looked at each other and burst out laughing in unison.
They stated in chorus "It's a box! How could you have a problem with it?"
 
One of our Elected Town Listers, and Assistant to the Selectboard, Sally Mills wrote a letter to the Selectboard regarding the "drop-box."
Under the Freedom of Information Act, The Fairfax News asked for a copy of Mills' letter, but we were denied for the reason that the request was not made in writing. There is no such requirement in the law.
The Fairfax News put the request in writing and again was turned down by Mills.
The Secretary of State's Office said to sue, a judge would force her to turn over the document and the townspeople would take care of the cost.
We chose not to do this.
 
After all was said and done, the Selectboard voted for Levick to remove the drop-box, even though the Selectboard has no authority over the Town Clerk's Office (Vermont Law).
The Selectboard's conclusion was that, and I quote "the box was too confusing."
 
I figure complaints like this lead to our paying Levick over $13K in financial settlement.
 
Now, Clarice, you closed with: "I think it is to the benefit of the town that it is being settled so that town business can go forward."
 
I wish it were so simple, but I believe the problem still remains in office.
If the incumbents remain past Election Day, I am afraid we will see more lawsuits.

Tina mentioned that every vote counts.
624 registered Fairfax voters happily re-elected Tina about ten months ago.

She mentions interference from the Selectboard (5 people),
the listers (2 people),
the treasurer (1 person)
and the delinquent tax collector (1 person)

That's 9 people.

Did 624 beat 9 ?
Did our votes count ?
Will our kids learn math ?

Notice of Intent to Perform
Whereas the Town Clerk has the authority and power to appoint one or more Assistant Town Clerks, 24 VSA 1170, and
Whereas the lawfully elected Town of Fairfax Town Clerk, Tina Levick, has lawfully appointed Barbara-Ann: Sempf as Second Assistant Town Clerk, and
Whereas the Town of Fairfax Selectboard has agreed to the Above, and
Whereas by statute, 24 VSA 933, and by the December, 2004 Decision and Conclusions of Law in Allard v. Town of Fairfax, the Selectboard has the power to fix the compensation for any or all Town Officers and Town employees, and
Whereas the Constitution of Vermont states, at Chapter 2, Section 61, that "...if any person is called into Public service to the prejudice of that person's private affairs, the person has a right to a reasonable compensation", and at Chapter 1, Article 1st, that "..no person... ought to be holden by law to serve any person as a servant {or} slave... unless bound by that person's own consent", and
Whereas The Constitution of the United States, at Article XIII, states that "Neither slavery nor involuntary servitude ... shall exist within the United States, and
Whereas the Said Second Assistant Town Clerk has been called into public service, with the reasonable expectation that the Right to a reasonable compensation will be given, and will not be infringed, and
Whereas the Assistant Town Clerk is authorized to perform the duties of the Town Clerk's Office in the absence of the Town Clerk, 24 VSA 1171, and
Whereas the said Town Clerk, Tina Levick, has, by lawful appointment, explicitly authorized the said Assistant Town Clerk, Barbara-Ann: Sempf, to so perform in the said Clerk's absence, and
Whereas the said Office of Town Clerk is not vacant, such vacancy being explicitly defined in 24 VSA 961, and
Whereas the said Assistant Town Clerk has not consented, and will not consent, to work or serve as a slave or involuntary servitude, nor has said Assistant Town Clerk in any way consented, and will not consent, to work or serve in any sort of "voluntary" servitude;
Therefor, I, Barbara-Ann: Sempf, do here state that, in accordance with all of the above, I am ready, willing and able to perform the said Office as soon as the said Fairfax Selectboard exercises its Lawful authority and fixes a Reasonable Compensation for the said Assistant Town Clerk.

I spoke with Lt. Dan Begiebing and Sheriff Robert Norris after the Selectboard meeting 12/6 and I picked up this note:

Currently, we pay the Sheriff about $28 per hour.
VT State Police will charge around $42 per hour.
VT State Police currently do patrol and respond to calls in Fairfax, included in your taxes.

I would like to comment on the criticism directed at the Franklin County Sheriff's Department from the Fairfax Selectboard.

In November, prior to deer season, Sheriff Robert Norris and I had several conversations regarding the break in problem in our area.

We brainstormed, compared notes and called in Lt. Dan Begiebing of the Vermont State Police and Representative Carolyn Branagan.

Through all these conversations, we concluded that the burglars were going up to the homes in daylight and knocking on the door.  If someone was home, the burglars would ask for directions to "so and so's" house.  If nobody answered, they used a credit card to gain access.

I volunteered to print that information in The Fairfax News and on December 2nd, the article "Daytime Break-Ins Plague Bedroom Community" appeared, instructing residents to call the Police with any suspicious activities, especially a couple asking for directions.

On December 3rd, two burglars approached a home in Fairfax and when the resident answered, they asked for directions to "so and so's" house.  The resident noted the license plate and make of car and called Franklin County Sheriff's at 524-2121. A dispatcher Cooper answered.

There was no cruiser available for Fairfax at that time, so he sent the info to VT State Police.  His brother, Trooper Cooper, responded and the State Police dispatched a cruiser to the suspect's house in St. Albans, where the car was discovered with watches, jewelry and electronics in sight on the back seat.  Warrants were obtained and two apartments full, and I quote the State Police, "a myriad of stolen property, was recovered."  Much of it from Fairfax.

Now, here comes my favorite part, included in the stolen property was a digital camera and it seems the burglars photographed themselves committing the crimes.

Property has been recovered, arrests have been made and for our Selectboard Chair, Mr. Blake, to make comments like "the Sheriff's will only be twice as ineffective if we double their hours", is ludicrous !!!

Hats off to Sheriff Robert Norris, dispatcher Cooper, and the Franklin County Sheriff's Department, Lt. Dan Begiebing, Trooper Cooper and the Vermont State Police and most of all, hats off to the anonymous tipster, who had the courage to call it in.
