7:15PM- J. Heyer called the hearing to order. The warning was read,introductions made, and interested persons sworn in.
Skip explained that the warning was sent out without indicating whether the proposal was Home Industry, Retail, or Restaurant because the approval process is the same for each. The Board still needs to classify the business.
Mr. Wimette proposes a one-night-a-week pizza takeout business from his home, located at 4 Gifted Rd.. He has a wood-fired pizza oven installed on his patio. The Board was shown pictures but the pictures were not entered into the file. He is proposing being open on Saturday (May through October only) from 4 PM to 8 PM (see below) on a call-ahead basis to minimize traffic and waiting. Mr. Wimette estimates they will prepare approximately 12 pizzas per hour and expects 6 to 8 cars per hour, totaling (at the most) 30 to 40 cars per night. He proposes to provide up to 6 temporary parking spaces in his driveway(marked off with orange spray paint) and additional parking, if needed, on the road in front of his house, but expects 4 cars maximum at a time. Mr. Wimette further stated that if there is interest that they may potentially add a second night (either a Thursday or Friday). There would be no additional employees besides family members. Health Department, trademark, and tax issues are being addressed with the State.
B. Murphy asked about operating hours and if Mr. Wimette expected the hours to begin earlier or extend later than stated. (Service will start at 4 and they will take orders until 8. Hours of traffic will be 4 until no later than 9).
There was additional discussion regarding well and septic, lighting, signage, water usage, health department regulations, and traffic issues on a private road and whether there are related covenants (Mr. Caissy stated that there is no Homeowners Association. The residents set a monthly fee that covers road maintenance only).
There was extensive discussion regarding parking within the setbacks on Gifted and Fletcher Rds. B. Murphy asked that conditions for approval include there be no parking on Gifted Rd. between the driveway and Fletcher Rd. Exhibits entered into evidence were:
1. Proposed Covenants, dated December 16, 1997
2. Minutes from November 18, 1997 Zoning Board of Adjustment hearing.
The Board found no need for a site visit to clarify parking.
There was additional extensive discussion regarding the classification of the business. Discussion centered on Home Business, Home Industry, Restaurant, or Retail business. There was discussion regarding parking within the setbacks if the business is classified as Retail.
B. Murphy moved to classify the business as Retail Sales; C. Rainville 2nd. The Board voted in favor 4-1.
There was no public input.
8:20 PM- C. Rainville moved to close to public input and move to deliberative; B. Murphy 2nd. All in favor.
