FAIRFAX DEVELOPMENT REVIEW BOARD                Wednesday, August 15, 2012

 

 

Frank and CristinJoyal and James Magnan Boundary Adjustment Administrative Review between their properties at 391 Berthiaume Rd and 527 Cherrierville Rd.

Applicants present: Frank Joyal, James Magnan

 

7:15 PM- J. Heyer called the hearing to order.  The warning was read, introductions made, and interested persons sworn in.

 

Skip Taylor presented the Administrative Review to the Board.  The Joyals’ own 2.3-acres with a house and barns, some of which are currently on Magnan property.  The Magnan property surrounds the Joyal property on the north side of Berthiaume Rd and totals 430 acres.  The Boundary Adjustment will add 4.34 acres to the Joyal property from the Magnan property.  This will include the necessary setbacks for the existing barns.  A farm road marks the east side of the property.  No easements exist for driveways.  There would need to be conditions for future easements if the property is ever sold.  Skip recommended the Board approve the Boundary Adjustment.

 

Mr. Joyal explained that the property is for sale and that the new boundaries will encompass all the existing barns.  There was discussion regarding driveways to the barn and the house (they are separate) and whether a future owner of the Joyal property would allow Magnan to use the farm road.  There was further discussion on changing the name on the map from Mary Joyal to CristinJoyal and whether that had ever been put on a new deed.

 

7:25 PM- B. Murphy moved to accept the Zoning Administrators recommendation to approve the Boundary Adjustment; C. Rainville 2nd.  All in favor
