LOCATION (specific): Vermont Route 100 near intersection of River View Road, Waitsfield, Vermont
 
VEHICLE #1 OPERATOR: Cameron Nevin
AGE: 20     SEAT BELT? Yes
CITY, STATE OF RESIDENCE: Moretown, Vermont

DESCRIPTION OF VEHICLE: 2001 Honda CRV
DAMAGE TO VEHICLE: Damage to Left Rear Quarter Panel and suspension

VEHICLE #2 OPERATOR: Trooper Benjamin Barton                         
AGE: 27    SEAT BELT? N/A

CITY, STATE OF RESIDENCE: Waterbury, Vermont
DESCRIPTION OF VEHICLE: 2008 Ford Crown Victoria
DAMAGE TO VEHICLE: Damage to Rear Bumper, trunk lid, tail light, bumper cover.
 
INJURIES: No injuries
 
WEATHER: Snow   
ROAD COND: Snow covered and slippery
 
SUMMARY OF CRASH: On the above date and time Trooper Barton stopped to assist a motorist who had gone off the road at the above location. Trooper Barton was parked on the edge of the road with his emergency blue light flashing and was outside of his cruiser when vehicle #1 approached from the south. Upon seeing the cruiser operator #1 hit his brakes and his vehicle started to slide sideways. Vehicle #1 subsequently struck the trooper's cruiser, then continued off the road. At the time the roads were snow and ice covered.
 
Operator #1 was at fault for this crash and was in violation of Title 23, VSA, section 1081(a), Basic Rule and Maximum Limits. This law states that "No Person shall drive a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions, having regard for the actual and potential hazards then existing. In every event speed shall be controlled as necessary to avoid colliding with any person, vehicle or other object on or adjacent to the highway." Operator #1 will be issued a Vermont Civil Violation Complaint for

even if you are being loaded into an ambulance and someone else hit you they will still give you a ticket,what a bunch of terrorists

It has always been that way Ed and I do agree that it is BS sometimes.  You could be going 20 on the interstate, hit black ice and end up off the road you still get a ticket for driving to fast for conditions.  I get the point of it is to slow people down but sometimes an accident is just an accident and isn't because of negligence on anyone’s part.

Wished that had been the case a few years back..of a ticket that is.  The young Burlington cop said the road conditions weren't good the day the oriental man whom could speak no English, hit us head on after crossing the yellow line, creamed/totalled my van & no tickets were given.  He hit us so hard it broke the wheel off the front of the van, pushed us up over the 6" or so curb, then spun around & nailed us in the back breaking open groceries, & sprung the frame of the van so bad we couldn't open the back gate!  Oh well, he did have insurance luckily!
